An Overview of White Collar Crime

If you ever end up in a situation where you may require a domestic violence attorney then you do not need to waste any time to find one that is knowledgeable in the type of defense you need. It is better to already have done your research before an issue arises but this may not always be the case.

Before you hire an attorney or take the advice of a friend or relative you need to make calls to the firm yourself and find out if they're specialized in these type of charges. Also find out if they have successfully defended a client with similar charges.

An Overview of White Collar Crime

Are you wondering what white collar crime is? Well, this term was coined by Sutherland in the year 1939. As defined by Edwin Sutherland white collar crimes refers to “a crime committed by a person of respectability and high social status in the course of his occupation”. Edwin Sutherland used the term ‘white collar crime’ in his speech at the American Sociology Society.

Though there have been lots of disputes as to which crimes can be covered by this term, usually non-violent crimes committed for financial gain are known as white collar crimes. These crimes are usually take place in commercial situations. White collar crimes can be very hard to prosecute especially because the people use sophisticated means for committing the crimes as well as conceal them.

Some of the very regular white collar crimes include:

•    Credit card fraud
•    Internet fraud
•    Telemarketing fraud
•    Violations of environmental law
•    Healthcare fraud
•    Bankruptcy fraud
•    Government fraud
•    Insider trading
•    Mail fraud
•    Security fraud
•    Financial fraud
•    Bribery

Some other offenses including money laundering, counterfeiting, kickbacks, public corruption, economic espionage, insurance fraud, tax evasion, antitrust violations, trade secret burglary and embezzlement are also known as white collar crimes.

As the report of Federal Bureau of Investigation show, these crimes cost the US government 0 billion per year. White collar crimes are very common in Miami. In most of the cases the government charges an individual for committing the crime. However corporations can be also sanctioned by the government for being involved in illegal financial transactions.

If you have been arrested for such a crime you can expect harsh penalties such as home detention, restitution, fines, supervised release, paying the cost of prosecution, community confinement, forfeitures as well as imprisonment. But the penalties can be narrowed only if the defendant admits his or her crime and help the authorities throughout the investigation procedure. Hiring a Miami white collar attorney can be of much help. Your lawyer will convince the judge and try to minimize the penalty.

Both federal and state laws count the behaviors that fall under white-collar crimes. The national government has the authority to control this kind of crime. Many other government agencies including the IRS or Internal Revenue Service, the FBI, the Secret Service, the EPA or Environmental Protection Agency, the U.S. Customs, the Securities and the Exchange Commission can help the federal government in implementing the laws. All the states of U.S also employ their own agencies to implement their own laws dedicated to white collar crime.

He’s not being contradictory, he is being evasive because Gohmert is trying to put words into his mouth. That’s how you’d respond too if you weren’t an idiot. Also, what relevance does his knowledge of legal action in Norway have to do with this questioning. And how is he supposed to fully answer the question and not be evasive when every time he starts to answer the question in a way that Gohmert does not like, he interrupts him and uses misdirection to make him look hypocritical.

wetweasel56 @ 11:37 am #

@drummer510cb… dude, you are an idiot for saying that. Are you aware of what Gohmert is asking Holder? Do you not see how Holder is being evasive, contradictory in his reply?

Holder is a corrupt Judge and he is proving it right before your dim witted eyes.

Gohmert is an idiot? Who votes for these people? Are you sure he went to school

Keep discussing this subject, as I’ve found the video interesting, but I’m not legally qualified to venture a guess or comment other than that. S I’ll leave that up to “ImTheSecretSquare” and “combatvetlawstudent” to debate, and just watch n read! ;)

please see my set of hate crime bill clips on my channel. Also see 18 USC 16 that defines violence. THAT definition is what is a great part of what is used to evaluate what constitutes a hate crime. The body of the text only lists the code as defining what is violence for purposes of the bill. So unless you know or look up the code you do not know what you are reading! FORGET synopsis read the text!

ImTheSecretSquare @ 1:42 pm #

@combatvetlawstudent It may have been your understanding that it applied to minorities – however, that is incorrect.

As for the Ft Hood shooter, why in the world do you think he would be charged with a hate crime? His actions were clearly not motivated by a bias against any particular group – he shot people completely indiscriminately.

And Kamau Kambon did not commit a crime any more than the Westboro Baptist Church did, so how would he be charged?

combatvetlawstudent @ 2:21 pm #

@ImTheSecretSquare also exterminate white people guy on the news and yt was not charged.

@combatvetlawstudent You said that the law “ignores other groups who are hated. Like Christians and military persons, veterans.” I responded by saying, “While you’re correct that the hate crime bill doesn’t cover veterans…, it most certainly does cover Christians.”

combatvetlawstudent @ 5:12 pm #

@ImTheSecretSquare hmmm ok well yes your correct that anyone hurting a certain class of person is guitly under the law proven in court. Having said that. I do not recollect impying in any way that Christians are exempt from being accountable for physical harm done due to hate of certain classes. Your response in what you said in your last once implies that I did say that? Or else why did you respond? Not sure.

ImTheSecretSquare @ 6:09 pm #

??? Not sure how your post responds to mine. I was simply saying that anti-white and anti-Christian hate crimes are just as illegal as anti-black or anti-Muslim crimes under the hate crimes statute.

Westboro picketing funerals isn’t committing a hate crime, they’re exercising their right to freedom of speech, as execrable as their speech may be. Were they to beat up a gay person, on the other hand, they most certainly would be charged with a hate crime.

combatvetlawstudent @ 6:29 pm #

@ImTheSecretSquare So in interpreting whether or not Christians still have rights I would say they surely do so long as they are willing to stand fro such right in a court of law.

combatvetlawstudent @ 6:37 pm #

@ImTheSecretSquare Are you aware that the Westboro Baptist church won their appeal? They have picketed all over the country funerals and churches contrary to their beliefs and hold signs everywhere saying godhates fags. They won on appeal a suit against them They happen to be attornies and know teh first amendment well. So well they can stand on corners saying fags should die and many other quite bold things that upsets many.

ImTheSecretSquare @ 7:31 pm #

Vet, while you’re correct that the hate crimes bill does not cover veterans (nor does any state hate crimes law), it most certainly does cover Christians.

As for “no hate allowed”, the bill covers ALL crimes motivated by bias against race, religion, sexual orientation, disability, and gender identity. About 1 in 5 race-related hate crimes are anti-white, for example.

Eric Holder is soft on Islamic terror and tough on Soldiers and the CIA both protecting us from their horror. Obama picks academics and sophists incapable of making decision that strengthen our ability to fight filth.

combatvetlawstudent @ 8:18 pm #

One lady was shouting in one vid haw haw how does it feel to be a minority now? She was happy about the hate crime bill as if it was for revenge and making those she felt made her a minority a minority. She had a correct perspective of the effect the bill does have. We cannot correct the past by making new victims of peopel today that may be in groups of peopel that may have been bias in the past or even today. Should make laws to demand equality for ALL people. NO hate allowed. Period.

combatvetlawstudent @ 8:43 pm #

My official take is ( on the issue of inequality of the bill) it is an oxymoron prupose of law to create NEW victims of inequality in ide to protect person of PAST inequality problems. Also it ignores other groups who are hated. Like Christains and military persons, veterans. I personally am for promoting equality laws to start anew in proomoting equality for ALL. Obama wants to MAKE UP FOR THE PAST but in so doing he is creating new victims of inequality.

jason101other @ 9:07 pm #

Eric Holder made no sense. One the one hand he said that “torture” is dependent on whether there wasn an “intent” to harm the, mentally or physically, the person being tortured. So the Rep points out that those doing the waterboarding were knew that they weren’t doing permanent harm, so it it torture? Holder has to hold then line that it was, so then, when backed into a corner, he said that it’s dependent on the “trier of facts” determination of whether or not there was harm.

sierrawlfc @ 9:58 pm #

Eric Holder now does what ever he wants, just like obama and the federal reserve. What is the definition of a hate crime, Anybody who owns a gun, anybody who speaks up, anybody who believes in the constitution. Get ready ,Yes We Can people the fool slayer is comming.
